Competencies
The competencies of the Attorney General's Office of Bosnia and Herzegovina are determined primarily by the Law on the Office of Attorney General of Bosnia and Herzegovina.
In accordance with the relevant law, the Attorney's Office performs the following tasks:
Representation
The Attorney General's Office of Bosnia and Herzegovina performs the activities of representation of its institutions financed from the budget of Bosnia and Herzegovina
before the Court of Bosnia and Herzegovina, and the institutions of Bosnia and Herzegovina in administrative proceedings, before the courts and other bodies of the Entities,
before the Court of Brcko District of Bosnia and Herzegovina as well as representation before administrative bodies in the Brcko District of Bosnia and Herzegovina regarding legal matters.
In addition, the Attorney General's Office of Bosnia and Herzegovina may represent the represented entities in an administrative dispute if authorized to do so.
The Council of Ministers of Bosnia and Herzegovina is represented by the Attorney General's Office of Bosnia and Herzegovina before the Constitutional Court of Bosnia and Herzegovina.
The Attorney General's Office of Bosnia and Herzegovina shall represent Bosnia and Herzegovina and its institutions both before international courts, courts of other countries,
international arbitrations and authorities of other countries, as well as before arbitration provided for in Article VIII of the Agreement between the Member States of the North Atlantic Treaty on the Legal Status
of their Forces, or the Agreement between the member states of the North Atlantic Treaty and other states participating in the Partnership for Peace on the legal status of their forces (PfP / NATO SOFA).
In accordance with the request of the Entities and the Brcko District of Bosnia and Herzegovina, the Attorney General's Office of Bosnia and Herzegovina may represent the Federation of Bosnia and Herzegovina
and the Republic Srpska, as well as the Brcko District of Bosnia and Herzegovina, before foreign courts, arbitrations, tribunals and other foreign state bodies and organizations.
Legal advice
The Attorney General's Office of Bosnia and Herzegovina provides expert assistance to the institutions of Bosnia and Herzegovina in resolving property law issues.
Opinions
The Office of Attorney General of Bosnia and Herzegovina gives opinions to the institutions of Bosnia and Herzegovina regarding the conclusion of property law contracts.
All institutions of Bosnia and Herzegovina financed from the budget of the institutions of Bosnia and Herzegovina are obliged to obtain the opinion of the Attorney General's Office of Bosnia and Herzegovina
prior to the conclusion of the contract on the sale, exchange, lease, receipt of the right to temporary or permanent use of the property, with or without compensation, concession contract ,
contracts for construction and association of funds for construction, as well as other contracts that dispose of things, ie material rights or acquire property in the ownership of Bosnia and Herzegovina,
if the value of such contract exceeds the amount of BAM 10,000.00.
Drafting of Law and other regulations
In the process of passing laws and other regulations governing property right relations, which acquire rights and create obligations towards property owned by Bosnia and Herzegovina,
the opinion of the Attorney General's Office of Bosnia and Herzegovina is obligatory.
